What Can a Construction Expert Witness Do for You?

10 July 2024

If you’re involved in a property dispute that has been taken to court, then it can be helpful to seek an impartial expert opinion on the matter at hand so that all the facts are taken into account and the dispute resolved efficiently and accordingly.

Keep reading to learn more about what a construction expert is and what they can do for you.

What is a Construction Expert Witness?

The easier way to answer this question is to first define what an expert witness is. An expert witness refers to an individual who possesses enough level of specialised knowledge or skill in a particular field that qualifies them to present their objective opinion about the facts of a case during legal proceedings.

It’s important to distinguish that the evidence provided by an expert counts as opinion evidence, rather than evidence of fact. However, it should not be dismissed, as their expert opinion can help the court to understand the evidence of fact and must be uninfluenced by either party.

A construction expert witness, then, is someone with a vast understanding of the construction industry. They are able to provide supporting testimony in order to inform the judge or jury on issues related to construction law, so that they can use this to inform their final decision in regards to the case at hand.

Some of the issues they could comment on may include:

●     Building delays

●     Building codes

●     Compliance with regulations

●     Construction costs

●     Construction defects

How Can They Help with Your Case?

It’s important to note that an expert witness must remain impartial when giving their genuine expert opinion in a case, so you should not expect them to blindly support your side or take on the role of an advocate. However, if you would like to seek a professional opinion on a dispute you’re involved with to better understand where you stand, then they can provide you with this.

This can save you from going into a case totally blind, which may even help lead to a settlement earlier on.

Construction expert witnesses may also be commissioned to disclose their opinion during the tribunal if your case is brought to court. They must prove their independence and their opinion can be dismissed if the judge or jury deems that their evidence is inadmissible due to a lack of proven independence. However, their evidence can ultimately help your case if you are in the right, as they are able to articulate the facts in a way that you may not have the expertise to do yourself.
